近日，最高法发布《关于修改<最高人民法院关于认可和执行台湾地区法院民事判决的规定>的决定 》。
《决定》扩大了申请认可和执行台湾地区法院民事判决的主体范围，增加了当事人的继承人和权利承受人作为申请人；明确申请人仅提出认可台湾地区法院民事判决申请,人民法院对应否认可进行审查并作出裁定；明确台湾地区法院民事判决具有给付内容的，人民法院在受理认可申请及作出认可裁定时，应当向申请人释明其可以向人民法院申请执行；强调身份证明材料在中国大陆以外形成的，申请人应当依据民事诉讼法及相关司法解释的规定履行证明手续，等等。
SPC Amends and Improves Rules on Recognition and Enforcement of Civil Judgments from Taiwan Courts

Recently, the Supreme People's Court issued the Decision on Amending the Provisions of the Supreme People's Court on the Recognition and Enforcement of Civil Judgments of Taiwan Courts.
The Decision expands the scope of entities eligible to apply for recognition and enforcement of civil judgments from Taiwan courts, adding heirs and rights holders of the parties as applicants; clarifies that when an applicant submits an application for recognition of a civil judgment from a Taiwan court, the people's court shall review and make a ruling on whether to recognize it; specifies that if a civil judgment from a Taiwan court includes a payment obligation, the people's court should inform the applicant that they may apply for enforcement when accepting the recognition application and making a recognition ruling; emphasizes that if identification documents are formed outside mainland China, the applicant must complete the certification procedures in accordance with the Civil Procedure Law and relevant judicial interpretations, among other provisions.
