日前，海关总署起草了《关于海关特殊监管区域卡口管理相关事项的公告（征求意见稿）》（下称《征求意见稿》），现就是否存在影响公平竞争事项面向社会征求意见，意见反馈截至2025年1月1日。
《征求意见稿》明确了卡口管理责任要求、卡口通道通行要求、卡口检查作业流程、途中运输管理要求、进出物品管理要求等。其中，《征求意见稿》规定，特殊区域管理机构是特殊区域的运行管理主体，应当合理设置特殊区域卡口，维护卡口设施设备正常运行，做好卡口通道分类引导，配备相应人力强化卡口值守以及维持通行秩序。发现非货运通道违规通行等异常情形时，应当及时通知并配合海关进行检查。此外，为加强卡口通行记录和追溯管理，有关数据应保存不少于3年。
GAC to Regulate Management of Checkpoints in Special Customs Supervision Areas

The General Administration of Customs (GAC) has drafted the Announcement on Matters Related to the Management of Checkpoints in Special Customs Supervision Areas (Draft for Comment) (the "Draft") and is now soliciting public comments regarding its potential impact on fair competition. The cut-off date for submitting comments is January 1, 2025.
The Draft specifies the responsibilities for checkpoint management, passage requirements for checkpoint lanes, inspection procedures, in-transit transportation management, and the management of goods entering and exiting the areas. According to the Draft, the management bodies of special areas, as the entities responsible for their operation and management, must ensure checkpoints are appropriately established, maintain the proper functioning of checkpoint facilities, provide clear guidance for categorized passage, allocate adequate personnel to strengthen checkpoint oversight, and maintain orderly traffic flow. In the event of irregularities, such as unauthorized passage through non-cargo lanes, the management bodies must promptly notify and cooperate with customs authorities for inspections. To enhance checkpoint passage record-keeping and traceability, relevant data must be retained for a minimum of three years.
