2023年9月1日，十四届全国人大常委会第五次会议表决通过《关于修改〈中华人民共和国民事诉讼法〉的决定》，自2024年1月1日起施行。
其中，主要修改包括：完善涉外案件地域管辖的相关规定；妥善协调管辖权冲突问题，完善相关规定；完善涉外案件送达的规定；完善外国法院管辖权的认定标准；增加与外国国家豁免法衔接的规定，等等。此次民事诉讼法的修改，着重对涉外民事诉讼程序制度进行完善，有利于进一步提升涉外民事案件审判质效，更好保障当事人的诉讼权利和合法权益，更好维护我国主权、安全和发展利益。
China Adopts Amendment to the Civil Procedure Law
The Standing Committee of the 14th National People's Congress voted to adopt the Decision on Amending the Civil Procedure Law at its fifth session on September 1, 2023. The amended law will take effect on January 1, 2024.
The amended law improves the relevant provisions on the territorial jurisdiction of foreign-related cases, coordinates conflict of jurisdiction by improving the relevant provisions, improves the provisions on the delivery of legal documents in foreign-related cases, refine the criteria for the determination of the jurisdiction of foreign courts, and adds provisions to establish a connection with the law on foreign countries' state immunity. By amending the law, the lawmakers aim to improve the foreign-related civil procedure, which will be conducive to improving the trial quality and efficiency of foreign-related civil cases, better protecting the legitimate rights and interests of litigants, and further safeguarding China's sovereignty, security and development interests.
