日前，商务部发布《关于执行不锈钢反倾销措施世贸组织争端裁决的立案公告》（下称《公告》）。
《公告》明确，对2019年第31号公告中不锈钢钢坯等反倾销案进行再调查，以使措施与世贸组织争端解决机构通过的“中国－对原产于日本的不锈钢产品反倾销措施”相一致。商务部可以采用问卷、抽样、现场核查等方式向有关利害关系方了解情况，进行调查。利害关系方应在规定时间内提交完整、准确的答卷。根据《公告》，利害关系方向商务部提交的信息如需保密的，可向商务部提出对相关信息进行保密处理的请求并说明理由。如利害关系方提交的信息未说明需要保密的，商务部将视该信息为公开信息。
MOFCOM Initiates Case in Response to WTO Dispute Settlement Panel Findings on Anti-Dumping Duties on Stainless Steel
Recently, the Ministry of Commerce (MOFCOM) has released the Announcement on Filing a Case Regarding the Implementation of the Findings of WTO Dispute Settlement Panel on the Anti-dumping Duties on Stainless Steel (the "Announcement").
The Announcement specifies a re-investigation into the anti-dumping case involving stainless steel billets, etc. as stated in Announcement [2019] No. 3, aiming to align China's measures with the obligations outlined in the China—Anti-Dumping Duties on Stainless Steel Products from Japan issued by the WTO Dispute Settlement Body (DSB). The MOFCOM may gather information from the interested parties through methods such as questionnaires, sampling, and on-site inspections, and conduct investigations. The interested parties are required to submit complete and accurate responses within the stipulated timeframe. According to the Announcement, if interested parties wish to keep certain information confidential, they may request the MOFCOM to treat such information as confidential and provide reasons for the request. In the absence of specified confidentiality requests, the MOFCOM will treat the submitted information as public.
