日前，商务部发布2024年第46号公告，决定加强相关两用物项对美国出口管制。
公告强调，一是禁止两用物项对美国军事用户或军事用途出口。二是原则上不予许可镓、锗、锑、超硬材料相关两用物项对美国出口；对石墨两用物项对美国出口，实施更严格的最终用户和最终用途审查。根据公告，任何国家和地区的组织和个人，违反上述规定，将原产于中华人民共和国的相关两用物项转移或提供给美国的组织和个人，将依法追究法律责任。
MOFCOM Tightens Export Controls on Dual-Use Items to the US

The Ministry of Commerce (MOFCOM) recently issued the Announcement [2024] No. 46, deciding to tighten export controls on certain dual-use items to the United States.
The Announcement stresses that: (1) export of dual-use items to US military users or for military purposes shall be prohibited; and (2) export of dual-use items related to gallium, germanium, antimony, and superhard materials to the US shall be prohibited in principle; stricter end-user and end-use reviews shall be implemented for the export of graphite-related dual-use items to the US. According to the Announcement, any organizations or individuals in any country or region who transfer or provide relevant dual-use items originating in the People's Republic of China to any organizations or individuals in the US in violation of the above provisions will be held liable in accordance with the law.
