Successful Holding of “American Trial Procedure” Exchange Activity

On Dec. 11, 2014, Tahota invited Mr. Zijun Guo, the legal counsel of American Embassy in China was invited to visit Tahota to deliver a speech on American Trial Procedure which is the key and complex procedure in American judicial system and can deeply reflect America judicial system and judicial spirit. Mr. Kelly Busby, the deputy consul of U.S. Consulate in Chengdu, chief partner Shoutai Cheng, senior partner Chunyan Ma, lawyer Feng Zhao of Tahota and other peers participated in this exchange activity and had professional and diversified discussion after the meeting.

The speaker lawyer Guo was graduated from the School of Law, Yale University and once served American law firms, U.S. Federal Appeals Court, U.S. Supreme Court, U.S. Federal Procuratorate of Southern District of New York. He is now the general legal counsel of American Embassy in China.

Based on abundant practice experience, Mr. Guo introduced in simple words plea bargaining system, jury system, cross-examination of the parties of prosecution and defense in court trial process and other court debate skills in U.S. judicial adjudication procedure, and cited true cases for explanation so as to vividly present U.S. judicial adjudication procedure which is widely different from the law system of Chinese mainland but worthy of research and reference. In the following Q&A and communication process, some lawyers had in-depth communication with Mr. Guo with regard to evidence principle in U.S. in criminal justice process, procedure, criminal trial supervision and other professional problems. Through full and high quality speech and interactive communication, it is proved that advanced judicial system can cultivate outstanding judges and lawyers and that the unremitting pursuit of the truth by outstanding lawyers will also promote justice progress.

Finally, Director Shoutai Cheng delivered a speech for gratitude. The two parties expected and promised to organize more academic and practical exchange and expressed the wish of law scholars in the United States and China can carry out more high quality official and unofficial activities on the exchange of law culture.
